Rental agreement and policies for all orders placed with Gilt and Linen

Thank you for choosing Gilt and Linen for your specialty linen rental and commercial linen cleaning needs. Please read the following Terms and Conditions carefully. By placing an order with Gilt and Linen LLC ("Gilt and Linen," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions, which form part of the Rental Agreement. Your use of this website constitutes your agreement to follow these terms and to be bound by them.
Gilt and Linen reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is your responsibility to review these terms before placing an order. Your continued use of our website or services following any changes constitutes acceptance of the updated terms.
When you browse our catalog and add items to your cart, the pricing and availability shown reflect current information as of that moment. A quote provided through the website or by our team is for your consideration only and does not reserve any items for your event date. Prices and availability are subject to change at any time without prior notification.
You may hold multiple product options on a quote for up to 15 days. If during those 15 days another client is ready to confirm and pay on any of the held items, Gilt and Linen will grant a 48-hour grace period for you to confirm or release the held items. After 48 hours, if no payment has been received, the items will be removed from the quote so that other interested parties can move forward.
Items are reserved for your event date only after we receive a signed Rental Agreement (if applicable) and the required retainer payment.
Orders may be placed through our website at giltandlinen.com or by email. An order is not considered confirmed until you have received written confirmation from us and a retainer equal to 50% of the total order amount has been collected. Once you confirm and pay the retainer, your quote becomes a confirmed order and the items are reserved for your event date.
You acknowledge that the retainer reserves the rental items for your event date, fairly compensates Gilt and Linen for lost rental opportunities for those items across multiple dates, and will not be refunded except as set forth in the Cancellations section below.
You are responsible for verifying the accuracy of your order including event date, delivery or shipping address, item quantities, colors, sizes, and fabric selections. Gilt and Linen is not responsible for errors resulting from incorrect information provided by the Customer.
A retainer equal to 50% of the total order amount is due at the time of confirmation. The remaining balance is due no later than two weeks before the event date and will be automatically charged to the credit card on file unless an alternate payment method has been arranged in advance.
Orders of $300 or less must be paid in full at the time of confirmation. Orders placed within one week of the event date must be paid in full at the time of confirmation regardless of order total.
All major credit cards are accepted (Visa, Mastercard, American Express, Discover). Except for clients with pre-established terms, we do not currently accept cash, personal checks, or business checks. You authorize Gilt and Linen to charge the credit card on file for all charges related to your order including rental costs, shipping and delivery fees, applicable taxes, damage waiver fees, and any damage or replacement fees as described in these terms.
Texas sales tax of 8.25% is applied to all rental charges and itemized separately on your invoice. You are responsible for paying any governmental taxes imposed on your orders.
If your order includes custom linens (custom-dyed fabrics, custom-cut sizes, or linens produced with your artwork or third-party fabric), those items must be paid for in full in advance, are non-refundable without exception, and cannot be modified once production has begun. Custom linen quantities on a confirmed order cannot be reduced.
Custom linens are final sale and are not required to be returned to Gilt and Linen after your event. If custom linens are mistakenly returned, you are responsible for any laundering or shipping costs related to sending those items back to you. Custom linens returned to us that are not claimed within 3 business days after notification will be discarded and are no longer eligible for return.
Requests for custom items involving your artwork or third-party fabric may require a separate Custom Production Agreement.
You may add items, remove items, swap selections, and modify delivery dates or addresses on a confirmed order up until one week before your event date ("Change Deadline"). No changes can be made after the Change Deadline, as the order will have been prepared and packed for shipment.
You may not reduce the quantities in an order by more than 50% of the original order after confirmation. Additions made after the Change Deadline are subject to availability and may require expedited shipping at additional cost. Gilt and Linen does not guarantee availability of additional quantities after an initial order is placed.
Slight color variation from one production run to another is normal and is not considered a defect. Refunds are not granted on the basis of dye lot variation. We assess our inventory regularly to confirm that items are within a reasonable threshold of variation, and all orders are composed of the most similar dye lot available at the time of rental.
More than 30 days before the event: Full refund of the retainer.
15 to 30 days before the event: A cancellation fee equal to 50% of the retainer applies. The remaining 50% is refunded.
Less than 15 days before the event: The retainer is forfeited in full.
After linens have shipped or been delivered: The order is considered final. No refund will be issued, and no credit will be given for unwanted or unused items.
If you need to reschedule your event to a new date rather than cancel, we will work with you to transfer your order to the new date at no additional charge, subject to availability.
Custom orders cannot be cancelled or credited at any time. See Section 4.
Linens are shipped via UPS or FedEx ground service at least 5 business days before the event date to allow a buffer in case of carrier delays. All shipments include a packing list, Gilt and Linen return bags (for orders of 3 or more items), and prepaid return shipping labels.
Shipping charges are calculated based on destination, weight, and service type, and are displayed at checkout. Expedited shipping is available at additional cost. Ground shipping does not provide guaranteed delivery dates. If you require a specific delivery date, you must select expedited shipping.
Upon receiving your order, please verify that the items match the packing list. If you are missing an item or receive an item that is damaged or stained, take a photo clearly showing the issue and contact us immediately at [email protected]. We will ship a replacement at no charge if time allows, or issue a refund for the affected item. Discrepancies reported after the event date are not eligible for refund or credit.
Gilt and Linen is not responsible for carrier delays, delivery exceptions, or other carrier-related failures to deliver. However, if your order does not arrive in time due to a carrier-related failure and you notified us promptly, we will issue a full refund for the affected items.
If an order does not arrive on time due to inaccurate information you provided (incomplete or incorrect shipping address, failure to verify dates), you are responsible for the full shipping cost of a replacement order where product is available.
We deliver within approximately 100 miles of Austin, Texas. Delivery fees are zone-based and displayed at checkout. Orders over $500 within 25 miles of our facility include complimentary delivery and pickup.
Delivery and pickup times will be coordinated with you in advance. All orders have a 3-hour delivery window. If you require a specific arrival time shorter than a 3-hour window, contact us to arrange a timed delivery, which may be subject to an additional fee.
If you do not provide delivery and pickup time preferences by the Change Deadline, Gilt and Linen will assign available time windows.
Upon delivery, please inspect your order to verify that the items received match the packing list. If you are missing an item or receive a damaged item, take a photo and contact us immediately. Refunds will not be issued for discrepancies reported after the event date.
Place all used linens into the Gilt and Linen return bags provided with your shipment. Verify that each bag has a prepaid return label clearly visible on the exterior. Returns are due within 3 business days after the event date. Gilt and Linen will schedule a carrier pickup, but it is your responsibility to ensure the carrier completes pickup by the scheduled return date. You may also drop the bags at any UPS or FedEx location.
Our team will pick up used linens from the delivery address at a scheduled time after the event. Pickup is included with local delivery service.
You do not need to wash, fold, or clean the linens before returning them. Cleaning is included in the rental price. However, you must ensure the following:
Returns received more than 3 business days after the event date may be subject to an extended rental fee. All rental property held beyond the agreed-upon return period is subject to extended rental fees at our standard daily rate. Contact us as soon as possible if you anticipate a delay.
You are responsible for returning all items included in your order. Missing items not returned within 7 days of the scheduled return date will be charged a replacement fee equal to three times (3x) the rental price of the missing item. This charge will be applied to the credit card on file.
You will be notified of missing items once your return has been received and processed. If missing items are located and returned to us within 14 days of initial notification, you are eligible for a 50% refund on the replacement charge. Full refunds are not available for missing items even if returned, due to the cost of lost rental opportunity and inventory replacement.
Pickup service for local orders does not absolve you of liability for items deemed missing from an order.
Normal event use is expected and included in the rental price. Food and beverage stains, wax drips, and minor scuffs are part of standard event use and are handled during our cleaning process at no additional charge.
If a linen is damaged beyond repair (burns, tears, cuts, permanent chemical stains, bleach damage, or other damage rendering the item unusable), you will be charged a replacement fee. Gilt and Linen reserves the right to determine what constitutes irreparable damage.
Gilt and Linen offers an optional Damage Waiver fee at checkout, calculated as a percentage of your rental subtotal (before tax, delivery fees, and any applicable discount). When selected, the Damage Waiver covers 100% of the replacement cost of accidental damage to rented linens.
The Damage Waiver does not cover:
When Damage Waiver coverage is denied due to gross negligence, you will be notified with photo documentation and issued a damage replacement invoice.
Payment of any damage or replacement invoice does not constitute a purchase. All rental property remains the property of Gilt and Linen.
All returned linens are counted and inspected at our facility using RFID tracking systems. Items are scanned individually upon return. Our counts are final.
You agree to use all Gilt and Linen rental products (tablecloths, napkins, runners, overlays, and any other items, collectively "rental property") in a careful and proper manner, solely for the purpose and in the manner for which the items are intended. You assume all risk of loss, damage, and abuse to rental property while in your possession.
You are responsible for inspecting your order upon receipt and reporting any discrepancies before the event date with photo documentation.
You shall not return rental property to any entity or person other than employees of Gilt and Linen or a freight carrier acting on behalf of Gilt and Linen.
For customers using our commercial linen cleaning service (processing of client-owned linens), separate service terms apply. Cleaning orders are invoiced per batch or monthly for recurring clients. RFID tagging of client linens is provided at no cost for the first 500 items.
Gilt and Linen is not liable for pre-existing damage, permanent stains, or normal fabric degradation on client-owned linens. Condition reports with pre-wash and post-wash documentation are provided after every cleaning cycle.
By providing your credit card information through our website or credit card authorization form, you grant Gilt and Linen authority to process said card for all charges related to your orders, including rental costs, damage waiver fees, shipping and delivery costs, taxes, and any damage or replacement fees.
You agree not to dispute, cancel, or chargeback any amount charged to your credit card on any basis that is fraudulent, misleading, or untrue. Any unauthorized dispute, cancellation, or chargeback will result in an additional fee of $150 charged to your credit card to cover administrative costs, in addition to any applicable collections costs.
You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. Notify us immediately of any unauthorized use. Gilt and Linen reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
You agree that Gilt and Linen may use images (photo or video) from events where our products are featured for our portfolio, website, and social media, provided we have obtained permission from the applicable photographer or videographer. If you do not wish to allow this, notify us in writing at the time of order confirmation.
All content on our website, including text, images, graphics, product photography, logos, and design, is owned by or licensed to Gilt and Linen and is protected by copyright, trademark, and other intellectual property laws. No content may be reproduced, distributed, or transmitted without our prior written consent. Product images may be downloaded for personal use only.
Event photographs appearing on our website are used with the express permission of the copyright holder. Downloading, copying, or reproducing event photographs from our website is prohibited.
If an individual or entity other than you pays for all or any part of an order, such payment by a third party does not relieve you of any liability under these terms, including payment obligations. If a third-party payor fails to make timely payments, you remain responsible for all payments for that order.
Gilt and Linen makes no warranty, express or implied, except that rental products are fit for the ordinary purpose for which such goods are used. There are no warranties which extend beyond the description provided on the website and order documents. All rentals are provided as-is. Customer acknowledges that the rental property is of a size, design, and quantity selected by Customer.
Gilt and Linen's maximum liability for any order shall not exceed the total amount paid by the Customer for that order. In no event shall Gilt and Linen or its owners, employees, directors, agents, or suppliers be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of our products, services, or website, regardless of the theory of liability, and regardless of whether Gilt and Linen was advised of the possibility of such damages.
If you are dissatisfied with any product or service, your sole and exclusive remedy is to discontinue use and seek a refund in accordance with the terms above.
You agree to indemnify, defend, and hold harmless Gilt and Linen LLC, its owners, members, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorney's fees and court costs) arising from or related to your use or possession of rental property, your use of our services, or any breach of these terms.
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, carrier disruptions, labor disputes, supply shortages, war, or civil unrest. This provision does not excuse the Customer from timely payment obligations or fees associated with cancellation, and does not apply to damaged or missing rental property.
These Terms and Conditions are governed by the laws of the State of Texas. Any legal action arising from or related to these terms shall be brought in the federal or state courts located in Hays County, Texas.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Gilt and Linen does not tolerate abusive, threatening, destructive, or harassing behavior from any customer or person affiliated with a customer. If we experience such behavior, we reserve the right to terminate the business relationship and cancel any outstanding orders.
These Terms and Conditions (together with any Rental Agreement and order documents entered into while these terms remain in effect) contain the entire agreement of the parties and supersede any prior written or oral agreements. These Terms and Conditions may be modified or amended only in a writing signed by all parties. If there is any conflict between these Terms and Conditions and the terms of a signed Rental Agreement, the terms of the Rental Agreement will prevail.
If any litigation is brought by either party to enforce rights or clarify obligations under these terms, the prevailing party shall be entitled to recover from the other party reasonable costs and expenses, including reasonable attorney's fees. If your credit card on file cannot be processed and you fail to make any payments on time after being notified, you agree to pay for Gilt and Linen's reasonable collections and legal costs incurred while attempting to collect.
Neither party shall assign, directly or indirectly, all or part of its rights or obligations under these terms without the prior written consent of the other party. Any assignment without such consent is ineffective, null, and void. Notwithstanding the foregoing, Gilt and Linen may assign these terms without your consent to an affiliate or in connection with the sale of all or substantially all of the assets of Gilt and Linen LLC.
